Beyond the Yard Terms of Service

These Terms of Service ("Terms") govern your use of the Beyond the Yard website, services, lessons, clinics, camps, training sessions, evaluations, communications, and online payment tools available through beyondtheyard.com and related channels (collectively, the "Services").

By accessing the website, booking a lesson, registering for a program, submitting information, or making a payment, you agree to these Terms. If you do not agree, do not use the Services.

1. Business Information

The Services are offered by Beyond the Yard LLC, doing business as Beyond the Yard ("Beyond the Yard," "we," "us," or "our").

2. Eligibility and Minor Participants

The Services are intended for athletes, parents, guardians, and team representatives. If a participant is under 18, a parent or legal guardian must register, agree to these Terms, and be responsible for all bookings, payments, authorizations, waivers, and communications on the minor's behalf.

If you register a minor, you represent that you are the parent or legal guardian or otherwise have authority to act for that participant.

3. Scope of Services

Beyond the Yard provides baseball and softball instruction and related athletic development services, which may include:

  • Private lessons

  • Weekly lesson slots

  • Group lessons

  • Camps, clinics, or scrimmages

  • Skill evaluations and feedback

  • Scheduling, waitlist, and booking communications

  • Online and saved-card payment options

We may modify, suspend, or discontinue any Service, coach offering, schedule, or pricing at any time.

4. Bookings and Scheduling

Lesson times, instructors, locations, formats, and availability are subject to change. A lesson slot is not guaranteed until it is confirmed by Beyond the Yard.

You are responsible for:

  • Providing accurate contact, participant, and payment information

  • Reviewing booking details before confirming

  • Arriving on time and prepared for the scheduled session

  • Monitoring your email, text messages, or other communication channels for schedule updates

We may refuse, reschedule, or cancel a booking when necessary for safety, instructor availability, facility limitations, weather, illness, low enrollment, or other operational reasons.

5. Payments

All fees must be paid as required at the time of booking or as otherwise communicated by Beyond the Yard.

By submitting payment information, you authorize us and our payment processors to charge the applicable fees, taxes, and any authorized cancellation or no-show charges tied to your booking.

If you choose or permit a payment method to be saved on file, you authorize Beyond the Yard to use that saved payment method for future lessons, programs, or authorized charges that you book or approve, subject to applicable law and any separate payment authorization you accept during checkout.

We may use third-party payment providers to process transactions. We do not control those providers' systems and are not responsible for third-party outages, delays, or security incidents outside our reasonable control.

6. Cancellations, No-Shows, and Refunds

Unless a different written program-specific policy applies, the following general rules apply:

  • Cancellations made at least 24 hours before the scheduled start time are eligible for a refund or credit, as determined by Beyond the Yard.

  • Cancellations made less than 24 hours before the scheduled start time are not eligible for a refund.

  • No-shows are not eligible for a refund and may result in forfeiture of the lesson slot.

  • Prepaid lesson packages, monthly blocks, or reserved recurring slots may be subject to separate written rules communicated at the time of purchase.

  • Approved refunds are returned to the original payment method, and processing times may vary by card issuer or bank.

If the website, checkout flow, invoice, or direct coach communication provides more specific cancellation terms for a particular program, those specific terms control for that purchase.

7. Waitlists and Recurring Lesson Slots

If Beyond the Yard offers recurring or reserved weekly lesson slots, those slots may be subject to additional scheduling expectations, including timely notice of absences, payment deadlines, and loss of priority for repeated cancellations or no-shows.

Waitlist placement does not guarantee a future booking. We may determine how waitlists are managed, prioritized, and cleared.

8. Assumption of Risk

Participation in baseball, softball, strength, conditioning, throwing, hitting, catching, fielding, pitching, and related athletic activities involves inherent risks, including falls, collisions, overuse injuries, strains, sprains, broken bones, illness, and in rare cases serious injury or death.

By using the Services or allowing a minor to participate, you understand and voluntarily assume these risks to the fullest extent permitted by law.

9. Health and Fitness Responsibility

You are responsible for determining whether you or your minor participant are physically able to participate. Do not attend or participate if ill, injured, contagious, or medically advised not to engage in athletic activity.

Beyond the Yard does not provide medical advice, diagnosis, treatment, or emergency medical services. You should consult an appropriate medical professional regarding injuries, health conditions, or return-to-play decisions.

10. Release and Limitation of Liability

To the fullest extent permitted by Texas law, Beyond the Yard and its owners, instructors, staff, contractors, affiliates, and facility partners will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages arising out of or related to the Services.

To the fullest extent permitted by law, our total liability for any claim arising out of or relating to the Services will not exceed the amount you paid to Beyond the Yard for the specific Service giving rise to the claim during the 12 months before the event giving rise to liability.

Nothing in these Terms excludes liability that cannot be excluded under applicable law.

11. Participant Conduct

You agree that you and any participant you register will:

  • Follow coach instructions and posted facility rules

  • Treat staff, athletes, and families respectfully

  • Use equipment and facilities safely

  • Refrain from abusive, threatening, discriminatory, or disruptive conduct

  • Refrain from attending under the influence of drugs or alcohol

Beyond the Yard may suspend or terminate participation without refund when conduct creates a safety issue, repeated disruption, harassment, or material violation of these Terms.

12. Communications

By contacting Beyond the Yard or providing contact details, you consent to receive service-related communications by email, phone, or text message for scheduling, bookings, reminders, billing, and customer support.

You are responsible for any carrier fees. Consent to receive operational messages is not a condition of purchasing promotional messages unless separately stated.

13. Intellectual Property

All website content, branding, logos, text, graphics, training materials, and other content made available by Beyond the Yard are owned by us or our licensors and are protected by applicable intellectual property laws.

You may not copy, distribute, modify, republish, sell, or exploit website content or training materials except for your personal, non-commercial use unless we give prior written permission.

14. User Submissions

If you submit reviews, feedback, testimonials, photos, messages, or other content to Beyond the Yard, you grant us a non-exclusive, worldwide, royalty-free license to use, reproduce, display, and share that content for business operations and marketing, subject to applicable law and any separate written agreement.

You represent that you have the right to submit that content and that it does not violate any third-party rights or applicable law.

15. Privacy

Your use of the Services is also subject to the Beyond the Yard Privacy Policy.

16. Third-Party Services and Links

The website may contain links to third-party websites, platforms, scheduling tools, social media services, maps, or payment processors. Beyond the Yard is not responsible for the content, terms, privacy practices, or availability of third-party services.

17. Disclaimer of Warranties

To the fullest extent permitted by law, the Services are provided on an "as is" and "as available" basis. Beyond the Yard disclaims all warranties, express or implied, including implied warranties of merchantability, fitness for a particular purpose, title, and non-infringement.

We do not guarantee that the website or Services will be uninterrupted, error-free, secure, or that training will result in any specific athletic, recruiting, team placement, or performance outcome.

18. Indemnification

You agree to defend, indemnify, and hold harmless Beyond the Yard and its owners, instructors, staff, contractors, affiliates, and agents from and against claims, damages, liabilities, losses, and expenses, including reasonable attorneys' fees, arising out of:

  • Your use of the Services

  • Your violation of these Terms

  • Your negligence or misconduct

  • Any claim arising from a participant you register

  • Your submitted content or violation of another person's rights


19. Governing Law and Venue

These Terms are governed by the laws of the State of Texas, without regard to conflict-of-law rules.

Any dispute arising out of or relating to these Terms or the Services must be brought exclusively in the state or federal courts located in Hays County, Texas, and you consent to that jurisdiction and venue.

20. Changes to These Terms

Beyond the Yard may update these Terms from time to time. Updated Terms become effective when posted to the website unless a later effective date is stated. Your continued use of the Services after updated Terms are posted constitutes acceptance of the revised Terms.

21. Severability

If any provision of these Terms is found unenforceable, the remaining provisions will remain in full force and effect to the fullest extent permitted by law.

22. Entire Agreement

These Terms, together with any posted policy incorporated by reference and any program-specific written terms provided at booking, form the entire agreement between you and Beyond the Yard regarding the Services.
